Nestmate Terms of Service

These Terms of Service govern Nestmate subscriptions and paid services. They supplement the general Terms of Use and explain billing, renewal, cancellation, and paid-feature access.
1. Agreement and scope
These Terms of Service are between you and Bold Yazılım Tasarım ve Ticaret LTD ŞTİ (“Nestmate,” “we,” “us,” or “our”). By starting a trial, purchasing a plan, or using a paid feature, you agree to these Terms of Service together with the Terms of Use, Privacy Policy, and Disclaimer.
If these Terms of Service conflict with the Terms of Use on a subscription or payment issue, these Terms of Service control for that issue. The Terms of Use continue to govern all other use of Nestmate.
2. Plans and paid features
Nestmate may offer monthly, annual, lifetime, family, promotional, or other plans. Features, usage limits, eligibility, and supported platforms may differ by plan and region. The plan details displayed immediately before purchase form part of these terms.
A subscription grants a limited right to access included features while the subscription remains active. It does not transfer ownership of the application, content, or underlying technology.
3. Prices, taxes, and payment
The price and currency shown at checkout apply to your purchase, subject to applicable taxes and app-store rules. Prices may vary by country, platform, currency, promotion, or purchasing channel. Your payment provider may charge exchange-rate or banking fees that we do not control.
When Apple or Google processes a purchase, that app store is the merchant or payment intermediary for the transaction and handles your payment credentials. We generally receive purchase status, product, price-related metadata, and transaction identifiers rather than complete card details.
4. Trials and promotions
Trials and promotional offers may be limited by account, family, device, payment method, region, or prior participation. Unless the purchase screen states otherwise, a trial converts to a paid, automatically renewing subscription when the trial ends if you do not cancel before the deadline shown by the app store.
Promotional benefits have no cash value, may not be transferred or resold, and may expire under the disclosed offer terms. We may reject fraudulent, duplicated, technically manipulated, or ineligible redemptions.
5. Automatic renewal
Recurring subscriptions automatically renew for the billing period shown at purchase until cancelled. Your app store may charge the payment method linked to your store account shortly before or at renewal. The store’s purchase interface and account settings provide the authoritative renewal date.
If a renewal payment fails, access may continue temporarily, enter a billing-retry or grace period, or end, according to the app store and applicable law.
6. Cancellation
You can cancel a subscription through the Apple App Store or Google Play account that made the purchase. Deleting Nestmate, logging out, deleting a child profile, or deleting your Nestmate account does not by itself cancel an app-store subscription.
Unless applicable law or the purchase terms state otherwise, cancellation stops future renewal and paid access continues until the end of the current paid period. You are responsible for cancelling before the app store’s renewal deadline.
7. Refunds
Refund requests for purchases processed by Apple or Google must normally be submitted to that app store and are governed by its refund rules and applicable consumer law. Where we process a payment directly, contact in-app support. Nothing in this section limits a statutory refund, withdrawal, or consumer right that cannot be waived.
8. Plan changes
An upgrade, downgrade, or switch may take effect immediately or at the next renewal, depending on the app store, plan, and purchase confirmation. Proration, credits, and the effective date are controlled by the terms shown during the change. Pending plan changes may remain subject to the current plan until the store confirms the transition.
9. Family access
A paid plan may enable features for a family or authorized caregivers when the plan description says so. The purchasing account remains responsible for managing the subscription and family access. Sharing outside the supported family features, reselling access, or circumventing plan limits is prohibited.
10. Service availability and feature changes
Some paid features depend on internet access, device compatibility, third-party stores, notification delivery, or data provided by caregivers. We may modify a paid feature to improve safety, reliability, compliance, or product quality. If we materially reduce a current paid plan, we will provide notice and any remedy required by applicable law.
Scheduled maintenance, security incidents, provider outages, or circumstances outside reasonable control may temporarily interrupt access. We do not guarantee that every feature will be available on every device or in every location.
11. Suspension and termination
We may suspend paid access for chargebacks, payment failure, fraud, misuse, or a material breach of the Terms of Use. We will act proportionately and provide notice where practicable. Termination does not erase payment obligations already incurred and does not remove rights that survive under applicable law.
12. No medical service
Payment for Nestmate does not create a medical, clinical, therapeutic, or other professional relationship. Paid reports, AI-assisted features, schedules, and insights remain informational and are subject to the Disclaimer.
13. Warranties and liability
The warranty disclaimers and liability limits in the Terms of Use apply to paid services to the extent permitted by law. Mandatory consumer rights remain unaffected. If a paid feature is not delivered as promised, available remedies may include correction, renewed access, a proportionate refund, or another remedy required by law.
14. Changes to these service terms
We may update these terms when plans, billing methods, laws, or paid features change. We will post a new effective date and provide advance notice or seek renewed acceptance when required. Price changes to a renewing subscription will take effect only as allowed by the app store and applicable law, with the notice required for your market.
15. Governing law and contact
These Terms of Service are governed by the laws of the Republic of Türkiye without limiting mandatory protections that apply where you live. Questions about a Nestmate plan may be submitted through in-app support. Questions about store billing, cancellation, or refunds should also be directed to the store that processed the purchase.
