Nestmate Terms of Use

These Terms of Use govern your access to and use of Nestmate, including its mobile applications, websites, reports, reminders, family features, and AI-assisted tools (collectively, the “Services”).
1. Who operates Nestmate
Nestmate is operated by Bold Yazılım Tasarım ve Ticaret LTD ŞTİ (“Nestmate,” “we,” “us,” or “our”).
2. Eligibility and caregiver responsibility
You must be at least 18 years old and legally able to enter into a binding agreement to create an account. Nestmate is designed for parents, guardians, and other authorized adult caregivers. It is not intended for children to use independently.
If you add information about a child, you confirm that you are the child’s parent, legal guardian, or an authorized caregiver and that you are permitted to provide and manage that information. You remain responsible for deciding who may access a family or child profile.
3. Accounts and security
You must provide accurate, current information and keep it updated. You are responsible for safeguarding your login credentials and for activity performed through your account. Notify us through the in-app support channel if you suspect unauthorized access. You may not share credentials, impersonate another person, or create an account using information you are not authorized to use.
4. Child, family, and tracking information
The Services let you record and view information such as child profiles, family relationships, sleep, feeding, diapering, growth, temperature, activities, milestones, schedules, reminders, notes, and related reports. You decide what information to enter. You are responsible for its accuracy and for reviewing information shared by another caregiver before relying on it.
Inviting a caregiver may give that person access to child and family information. Only invite people you trust, review family access regularly, and remove access when it is no longer appropriate.
5. Acceptable use
You may use the Services only for lawful, personal, and household caregiving purposes. You must not:
- use the Services to harm, exploit, monitor without authority, or violate the privacy of a child or another person;
- upload unlawful, infringing, deceptive, malicious, or unauthorized content;
- probe, disrupt, bypass, reverse engineer, scrape, or overload the Services or their security controls, except where applicable law expressly permits it;
- use automated means to access the Services without our written permission;
- resell, sublicense, or commercially exploit the Services; or
- use reports, AI-assisted outputs, or other content to make unlawful discriminatory or high-risk decisions about another person.
6. Your content
You retain ownership of information, notes, images, messages, and other content you submit (“User Content”). You grant us a limited, non-exclusive license to host, process, reproduce, and display User Content only as needed to operate, secure, maintain, and improve the Services, comply with law, and provide features you request. This license ends when the content is deleted from active systems, subject to lawful retention and backup cycles described in the Privacy Policy.
You confirm that you have the rights and permissions necessary to submit User Content. Do not upload content that you do not want authorized family members to see through shared features.
7. Health information and AI-assisted features
Nestmate provides organizational, informational, and educational tools. It does not provide medical diagnosis, treatment, or emergency services. AI-assisted responses, trends, schedules, percentiles, summaries, and reports may be incomplete, delayed, or inaccurate and must be reviewed by an adult caregiver. 8. Intellectual property
The Services, including their software, designs, trademarks, text, graphics, and non-user content, are owned by us or our licensors and are protected by applicable intellectual property laws. Subject to these terms, we grant you a limited, personal, revocable, non-transferable, and non-exclusive right to use the Services for their intended purpose. No other rights are granted.
9. Third-party services and app stores
The Services may rely on or link to third-party platforms, app stores, payment providers, maps, notification services, analytics tools, or other services. Their own terms and privacy practices apply to your relationship with them. We are not responsible for third-party services we do not control. Additional app-store terms may apply to your download and use of the application.
10. Availability and changes
We work to keep the Services available and reliable, but we do not promise uninterrupted or error-free operation. Features may change as we improve the product, respond to security or legal requirements, or retire functionality. We will provide reasonable notice when a material change adversely affects an active paid service, where required by law.
11. Suspension, termination, and account deletion
You may stop using Nestmate or request account deletion through available account controls or in-app support. We may limit, suspend, or terminate access when reasonably necessary to protect users or children, secure the Services, comply with law, address non-payment, or respond to a material or repeated breach of these terms. Where appropriate, we will provide notice and an opportunity to remedy the issue.
12. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” We do not warrant that every result, reminder, prediction, report, third-party link, or synchronized record will be complete, accurate, timely, or suitable for a particular purpose. Nothing in these terms excludes warranties or consumer rights that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential loss arising from use of or inability to use the Services. Our aggregate liability relating to the Services will not exceed the greater of the amount you paid for the affected Services during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law. These limits do not apply where liability cannot legally be limited, including liability caused by fraud, willful misconduct, or gross negligence.
14. Privacy
Our collection and use of personal data are described in the Privacy Policy. The policy also explains how to exercise privacy rights and request account or data deletion.
15. Governing law and consumer rights
These terms are governed by the laws of the Republic of Türkiye, without limiting mandatory consumer protections that apply where you live. Courts and authorities with jurisdiction under applicable law may hear disputes. Before filing a claim, we encourage you to contact us so we can try to resolve the issue informally.
16. Changes to these terms
We may update these terms to reflect changes to the Services, law, or our practices. We will post the updated version with a new effective date and provide additional notice or request renewed acceptance when required. Continued use after an update takes effect means you accept the revised terms, unless applicable law requires another form of consent.
17. General terms
If a provision is found unenforceable, the remaining provisions remain effective. A delay in enforcing a right is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a merger, reorganization, or sale, subject to applicable law and the Privacy Policy. These terms and the documents linked above form the agreement concerning your use of the Services.
